#02-2763 Clayt and Julie Tabor <br />960 North Brown Road <br />Pa e 4 of 4 <br />Staff has received one call from a concerned property owner in the area that they had received <br />information that the property may be available for a future town house development. Staff <br />advised the neighbor the zoning of the property would not permit a town house development. <br />The caller also stated they were not in favor of the development that would create a second <br />building site. <br />Planning Commission Review <br />The Planning Commission in not required to take a final action on a Sketch Plan. They did have <br />a consensus that the proposed lot division would not be consistent with the City's philosophy on <br />rural zoning districts. The granting of a lot area variance has the potential to set a precedence for <br />lots that are close to, but do not meet the minimum requirements for subdivision. <br />Planning Commission also requested the Council review the application to determine if the <br />proposed lot area variance is something that would be considered for this individual application, <br />and other similar requests in the future. <br />Staff Recommendation <br />Staff requests the Council reviews their policy on lot divisions that would create sub-standards <br />lots and/or spot zoning. Staff has reviewed the individual sections of the zoning and subdivision <br />ordinances as well as the Comprehensive Plan and has determined the proposed division is not <br />consistent with what the City of Orono has been doing since the 1975 zoning of the City. <br />If the City of Orono were to approve the request as presented the City would also have to review <br />the goals and policies within recently adopted Comprehensive Plan and Zoning/Subdivision <br />Ordinances.
