City of Orono <br />October 27, 2000 <br />Page2 <br />MOSS & BARNETT <br />A Protess1onal Assoc1aunn <br />Based solely upon our examination of the copies of the Policy, the Deed and the Affidavit, we <br />are of the opinion that, as of October 13, 2000, record title to the Property was vested in DSR <br />Investments LLC, and that title to the Property is free and clear of all encumbrances, except for: <br />1. The lien of real estate taxes and installments of special assessments payable in <br />2001 and subsequent years; <br />2. Any judgments or tax liens against, or bankruptcy proceedings involving, DSR <br />Investments LLC; <br />3. Rights of the public, the State of Minnesota and the U.S. Government to use that <br />part of the premises which lies below the high water mark or U.S. Government <br />Harbor line of Dickeys Lake; <br />4. Rights, if any, of any riparian owners and of the public to use the surface, sub- <br />surface, and bed of Dickeys Lake; and <br />5.
