Mabusth <br />Title Building & Zoning Administrator <br />DATE: December 5, 1995 <br />ITEM NO.: <br />Agenda Section: <br />Zoning <br />Item Description: #2092 Dennis Platteter, 809 Brown Road North -Preliminary Subdivision - <br />Resolution <br />Zoning District: RR-lB <br />Total area 5.64 acres (exclusive ofright-of-way of North Brown Road and Dickey Lake) <br />Brief Review of Application <br />Please refer to the enclosed staff memo dated November 16, 1995 and the minutes of the Planning <br />Commission meeting of November 20th for more background and detail on this review. <br />The applicant submitted a sketch plan of three lots at the August 1995 meeting of the Planning <br />Commission. The Planning Commission had to recommend against the division because of the need <br />to grant lot standard variances for the creation of new lots. Applicant has filed a formal subdivision <br />application of two lots (back lot/front lot). Lot 1, the western lot, meets 150% of all required <br />standards. Review Exhibit G, Lot 1 's building envelope is defined by the street or east lot line <br />setback at 75' and the side setbacks 45'. <br />Lot 2's building envelope must also be redesignated showing a 50' setback along Outlot A, the <br />driveway outlot, and the west or rear lot line. <br />Applicant has advised that all accessory structures will be removed. To be consistent with previous <br />approvals, the City will allow one year from the date of Council's approval of the final plat for the <br />removal of accessory structures. <br />Both lots will achieve access via the driveway outlot. If any upgrades of the driveway are <br />contemplated in the future, all improvements must be located 1 O' from the south lot line of Outlot <br />A. <br />Applicant has recently advised staff that all accessory structures will be removed. The large barn <br />at 2,100 s.f. is currently being dismantled for removal to another property. The pool will also go. <br />As of this date, applicant is not certain whether the house is to be removed. Staff would advise that <br />at the time of final plat approval if applicant advises the house is to remain, then lot line should be <br />adjusted so that structure meets 75' setback from east line of Lot 1.
