#796 - Lachlan Reed <br />January 19, 1984 <br />Page 2 <br />In order to issue a variance to the performance standards in <br />question, the Council must make the findings set forth in Zoning <br />Code Section 32.340 (a, b, c, d, & e). <br />Planning Commission Recommendation - to recommend approval of the <br />variance to certain performance standards of the home occupation <br />accessory use application of Lachlan Reed, in a split vote of <br />4 in favor and 2 against, subject to the following conditions: <br />i) Applicant to sign -off on resolution stating that his special <br />accessory use will ccise when the applicant no longer owns <br />Lot 1, Block 1. This special home occupation use is only <br />approved for applicant while he owns both Lots 1, & 3, Block 1. <br />Any change in ownership would terminate this special accessory <br />use and the new owner of Lot 1 would have to reapply for such <br />use of accessory structure. <br />2) Accessory structure on Lot 1, Block 1 may never be used as a <br />residential unit. <br />3) Variance approval lim'ts applicant to one employee. <br />4) Septic system Lerving accessory structure to be inspected by <br />On -Site Manager. <br />5) Deck is not approved in this recommendation. If fire code <br />requires external access from second story, then a staircase <br />may be constructed. <br />Minority Opinion (Callahan & Goetten) <br />"Goetten bated that this is not an accessory use to the primary <br />homestead residence, it is a substandard setback for the garage, the <br />occupation must be conducted within the principal structure and no <br />employee is allowed in Section 32.340. Goetten noted that they would <br />be setting a precedent by approving this use." <br />Callahan agreed with Goetten and noted that it doesn't fit in the <br />general area and long range planning of the City. <br />Council action - give staff conceptual direction to approve or <br />disapprove and call for a resolution to be drafted for the next <br />scheduled Council meeting. <br />
