Thc trai.l on Tamarack Drive commencing at WetIand Number 12 and north will bs subject to future design and construction. � 5. In addition to tho cons�truction uadertalcing above, Spring Hill will contribute up to 520,040 towards trail constnction in the vicinity of the golf course, � 6, City sta.ff and cngineers will participatc in the layout and engineeri.ng of the trail,at iha City s expense. City will be responsible for obtaining a11 pesniits required for the trail. 7. Spring Hill a�ees to traasfer to the City two-fhirds of the excess wetland mitigation c�'edits resulti.ng from construction of the golf course in Orono. The credits will be utilized for trail system and, to the extent any remain,will be available to the City of Orono. The remaining one- . � third wiIl�be retained by Spring Hiil for possible future modifications of the golf course,subject to applicable laws and governmcnt approvals. Spring Hill agrees not to sell or otherwise transfer tbese credits from thc golf cvurse sita , 8. Spring Hill may cons�uct at its expense, a n�stic split rail fence between the ttail and the golf course on those locations where,for safety and separation reasons,planti.ng and�berm.ing is � not feasible. Spring Hill will not coristivct any fcnce which will prevent the free movement of wild life in the area of the golf course, 9.
