VYiTNE9S�TH: . . - .. <br /> WHERE�iS, Spring Hill has made application to the City Council for approval of the <br /> construction and operaiion of a goif cours�; and <br /> � W�iEREAS,the City Council has granted approval for such devslopment on the condition <br /> that Spring Hill�vill,provide certain easements and cons�uction activities and centralize certain costs <br /> for the eity's trail system on the peri.mcter of thc Spring Hill property. <br /> NOW T�iEREFORE, in consideration of the premises, and of on�dollaz and other good <br /> and valuable consideration,it is hereby agreed as follows: <br /> 1. Spring Hill will d�cd to the City for na�inal consideration an easement to extend the � � <br /> City's rig,ht-of-way approximately tcn feet north of its existing right-of-way along Spring F�11 Road • <br /> from East Long Lake Road to County Road 6, and ten feet east of the right-of-way of Tamarack <br /> Drive from County Road 6#o the City line.In some cases,more than ten feet will be required.The <br /> precise expansioa of the rigbt-of way will vary depending on the topography and may in some cases <br /> exc�ed or.be les.s than ten feet Any.malification of the ten feet easement referred to�in this <br /> paragraph is subject to mutual agr�amerrt of the City and Spring Hill, <br /> 2.
