Applicant shall obtain an NPDES permit from the <br /> Minnesota Pollution Control Agency if required. Applicant shall use its best efforts to <br /> obtain and maintain membership in the Audubon Cooperative Sanctuary Program. <br /> 6. FUEL & CHEMICAL STORAGE. Fuel and chemical storage facilities are approved as <br /> described and as shown on the approved site plan(lEuhibit B-13A)subject to the appropriate <br /> federal and state agency and local permits and pertinent code requirements, and subject to <br /> . appropriate natural screening to make said storage facilities�mostly invisible from off <br /> site. <br /> 7. INFRASTRUCTURE IMPROVEMENTS. <br /> A. COUNTY ROAD 6 ACCESS. Applicant shall design and have constructed <br /> an auxiliary lane for westbound County Road 6 traffic across from the entrance to the <br /> a . property,and implement such other safety measures as shall be agreed between applicant and . <br /> the Hennepin County Department of Public Works. <br /> B. TUNNEL. The City will enter into a cooperative agreement with Hennepin <br /> Courity to identify legal and technical responsibilities for the tuunel under County Road 6. � <br /> Applicant shall concurrently enter into a cooperative agreement with the City regarding said <br /> tunnel, and applicant shall accept all reassigned responsibilities for the tunnel as may be <br /> deemed appropriate by the City Council.The tunnel shall be designed and installed to meet <br /> all appropriate County and City requirements. <br /> C. TRAIL SYSTEM. Applicant shall work with the City in establishing a trail <br /> system to be dedicated to the City for public use as described in Exhibit I9. <br /> � D. CONDITION OF SPRING HILL ROAD. Any damage to Spring Hill Road � � <br /> caused by the applicant or his agents as a result of this project shall be repaired at the <br /> applicants' expense to the satisfaction of the Public Services Director, and as may be further <br /> addressed in the Developers'Agreement. <br /> � � 8.
