Subject: #15-3746, James Hillier, 1224 Briar Street <br />Background <br />The applicant is proposing to construct a new single family home on the property and is <br />requesting lot area, lot width, rear yard and side yard setback variances in order to do so. The <br />property is just under a quarter of an acre in area and has 75 feet in width where 2.0 acres in <br />area and 200 feet in width are required . The applicant is proposing setbacks of 31 .5 feet from <br />the rear lot line where a 50 foot setback is required; and 13.2 feet from the south side lot line <br />and 10 .3 feet from the north side lot line where 30-foot setbacks are required. <br />Staff finds practical difficulties exist to support redevelopment of this property, such as the <br />substandard lot area and width are not the result of actions by the landowner; the applicant is <br />proposing to construct a new single family home which is reasonable and consistent with the <br />comprehensive plan . The hardcover and structural coverage proposed meet the requirements <br />of the Zoning code . Granting rear and side setback variances in addition to the lot area and lot <br />width variances to redevelop this property will not merely serve as a convenience to the <br />applicant. The proposed home and setbacks appear to be consistent with the goals of the <br />comprehensive plan; fit the character of the neighborhood; and do not appear to adversely <br />impact adjacent properties. <br />Staff Recommendation <br />Planning Staff recommends approval of the requested lot area, lot width, side setback and rear <br />setback variances in order to redevelop the subject property.
