The Planning Commission shall consider recommending approval for variances from the literal <br />provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship <br />because of circumstances unique to the individual property under consideration, and shall recommend <br />approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the <br />Orono Zoning Code. <br />Issues for Consideration <br />Clearly the condition of having a 0-75 foot zone on three sides of this lot that comprises 55 <br />percent of the property reduces the overall allowable hardcover as compared to lots with only <br />one side abutting the lake. An argument might be made that if the runoff could be forced to <br />filter through all that 67,00 s.f. of Oto 75 foot area, it would be treated better than having it <br />run through the 15,000 square foot zone of a 200 foot wide 2.84 acre lot. But it's not very <br />likely that the runoff could be spread out in such a manner. Ultimately, the Planning <br />Commission should attempt to determine whether a reasonably sized home with reasonable <br />amenities and driveways could be developed without a hardcover variance. In doing this the <br />Commission should discuss each of the relevant parameters from Section 78-123.
