REGULAR MEETING OF THE ORONO COUNCIL, JUNE 12, 1979 <br />Page 5 <br />Butler moved, Hurr seconded, to adopt Resolution <br />#1038, A Resolution Approving A Registered Land <br />Survey For R. L. Wenkstern, 645 North Arm Drive. <br />tiution, Ayes (4) - flays (0) . <br />fir. Alan Olson, City Planner, informed the City <br />ouncil that Dr. Dunlap has signed Resolution <br />1028 concerning the proposed dredging in the <br />lagoon on his property. His neighbor, fir. Aines, <br />refuses to be a part of the project or to sign <br />the resolution. Dr. Dunlap further sees no <br />reason to file the resolution in his chain of <br />title. <br />As per my review at the April 24, 1970 meeting, <br />the dredging activity has no effect, positive <br />or negative, c.z the riparian access or future <br />division of either lot. Therefore, I recommend <br />that Resolution #1028 be amended by deleting <br />certain sections on Page 4 per the attached <br />copy. <br />Butler rloved, 'furr seconded, to approve the <br />amen �d ResolLLion #1028 for the conditional <br />use permit of David Dunlap, 1595 Bohns Point <br />Road. Motion, Ayes (4) - Nays (0). <br />fir. Alan Olson, City Planner, entered into the <br />ecord the request of Richard Oliver, 3898 Cherry <br />,7en ue, for a conditional use permit, dated <br />ebruar} 21, 1979, which states- <br />Wor' ssion - The garage and g uost apartment at <br />389� ILerry Avenue wa- damaged by fire on <br />February 3, 1979. We have been inforitted that the <br />apartment was rented a a ,Tim and Cindy Poulton. <br />The renting of an apartment in a residential zone <br />is a violation of the Zoning Code, Section 34.027. <br />34.027 Guest Houses: A separate dwelling constructed <br />on an existing undivided lot for the sole use <br />of the occupants of the principal buildings, <br />including their domestic employees or their non- <br />paying guests. All regular lot requirements shall <br />be met by the guest house. <br />Mr. Oliver has been informed of the violation and <br />because of this, staff has advised him to apply <br />for a conditional use permit. Please note, staff <br />did not base their action on percentage of damage <br />done to orig•.nal a ucture. The house is in the <br />process of being sold and the guest apartment <br />was considered In the overall sale price.
