CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ti <br /> t4KES H 00' <br /> NO. 4 1 0 <br /> xi. The existing stone building located adjacent to the roadway was <br /> the former pumphouse for the Woodhill Country Club, is a <br /> landmark in the neighborhood, and at 16'x22' will not detract from <br /> the neighborhood if allowed to remain in place. The proposed 8.4- <br /> foot setback between the proposed home and existing stone <br /> structure occurs only at a corner and constitutes an encroachment <br /> of approximately one square foot. The encroachment has no <br /> significant visual impacts and access to the lakeshore yard is <br /> available south of the stone building. <br /> xii. The amount of hardcover on the property will be reduced by more <br /> than 700 square feet as a result of the new construction. <br /> b. Approval of the conditional use permit based on: <br /> i. The proposed filling of the flood plain totaling 127 cubic feet will be <br /> offset by the proposed 199 cubic feet of floodplain mitigation <br /> proposed, hence flood storage capacity of the property will not be <br /> reduced. <br /> ii. Pending approval of the floodplain mitigation by the Minnehaha <br /> Creek Watershed District (MCWD) and issuance of necessary <br /> permits. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, <br /> comments by the Applicant and the public, and the effect of the proposed <br /> variances and conditional use permit on the health, safety and welfare of the <br /> community as well as the impact on properties in the vicinity. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the Applicant, but is necessary to alleviate a <br /> practical difficulty; is necessary to preserve a substantial property right of the <br /> Applicant; and would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> Page 4 of 7 <br />
