-oIv <br /> CITY OF ORONO <br /> RESOLUTION OF TeE4InCOUNCIL <br /> y � <br /> kESHO�� <br /> �> N O. <br /> WHEREAS, the Applicant has made application to the City for a variance to <br /> Orono Code Section 78-1279(6) for an average lakeshore setback variance to permit <br /> portions of the proposed home to encroach closer to the lake than the adjacent residence; <br /> and <br /> WHEREAS, the Applicant has made application to the City for a conditional <br /> use permit per Orono Code Sections 78-966, 78-967 and 78-1286 for land alteration to <br /> conduct grading activity within the 0 to 75 foot zone and within the designated 100-year <br /> floodplain in conjunction with removal of the existing home and construction of the new <br /> home; and <br /> WHEREAS, the approvals currently requested for the proposed plan are <br /> identical to the plan approved for the Property via Resolution 6133 which expired on April 9, <br /> 2013; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on May 19, 2014, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was originally reviewed as Zoning File #12-3544; the current <br /> renewal application is reviewed as Zoning File #14-3668. <br /> 2. The Property is located in the LR-1A zoning district, where 2.0 acres is the <br /> minimum lot area and 200 feet is the minimum defined lot width. The <br /> homesite within the Property is approximately 0.69 acre in contiguous area <br /> and 140 feet in defined width. <br /> 3. The Planning Commission reviewed this application on May 19, 2014, and on <br /> a vote of 7 - 0 recommended: <br /> a.
