gOi SCANNED <br /> CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> 610 <br /> NO. <br /> 4kES H00' <br /> A RESOLUTION <br /> GRANTING VARIANCES <br /> TO ORONO MUNICIPAL CODE <br /> SECTIONS 78-305, 78-1279, 78-1288, 78-1438 & 78-1700 <br /> AND <br /> A CONDITIONAL USE PERMIT PURSUANT TO <br /> ORONO MUNICIPAL CODE SECTIONS 78-966, 78-967 & 78-1286 <br /> TO ALLOW LAND ALTERATION WITHIN THE LAKESHORE SETBACK <br /> FILE NO. 14-3668 <br /> WHEREAS, Mary J. Bowman Trust (hereinafter "Owner") is the owner of the <br /> property located at 1165 Ferndale Road West within the City of Orono (hereinafter "City") <br /> and legally described as: <br /> Exhibit A (Attached) <br /> (hereinafter "the Property"); and <br /> WHEREAS, Charles Cudd De Novo (hereinafter the "Applicant") has made <br /> application to the City on the Owner's behalf for variances to Orono Code Section 78-305(b) <br /> to construct a replacement residence on a lot with a contiguous area of 0.69 acres and a <br /> defined width of 140 feet when 2.0 contiguous acres and 200 feet of width are required; and <br /> WHEREAS, the Applicant has made application to the City for variances to <br /> Orono Code Section 78-305(b) to construct a replacement residence on the Property with a <br /> rear/street setback of 33 feet when a 50 foot setback is required; and a side setback variance <br /> to allow a 27.2 foot side yard setback where a 30 foot setback is required; and a rear/street <br /> setback variance to allow an existing stone building to remain 0' from the property line where <br /> a 50-foot setback is normally required; and for a variance to Section 78-1438 to allow the <br /> new residence to be located 8.4 feet from the stone structure where a 10-foot building <br /> separation is normally required; and <br /> WHEREAS, the Applicant has made application to the City for a variance to <br /> Orono Code Section 78-1279 to construct a replacement residence on the Property with a <br /> lake setback of 47 feet when a 75 foot setback is required; and <br /> WHEREAS, the Applicant has made application to the City for a variance to <br /> Orono Code Section 78-1288 to permit 1,183 square feet or 3.9% hardcover within the 0-75- <br /> foot zone where no hardcover is allowed in order to construct a replacement residence on <br /> the Property; and <br /> Page 1 of 7 <br />
