CITY of ORONO <br /> i k, Alt /µ �� RESOLUTION NO <br /> OF TEXIY COUNCIL <br /> " .t ii i1 .4G v <br /> 4/'Esx04`' <br /> A RESOLUTION APPROVING <br /> 4 SUBDIVISION OF A LOT LINE REARRANGEMENT <br /> AND EXTINGUISHMENT OF THE CONDITIONAL USE PERMIT <br /> GRANTED WITH RESOLUTION NO.4836 <br /> FILE NO. 13-3640 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> R <br /> WHE EAS, the City Council of Orono (hereinafter "City Council") has adopted <br /> subdivision regulatio�is for the orderly, economic and safe development of land within the City; <br /> and <br /> WHE EAS, James Murphy and Sandra S. Smith, a married couple (hereinafter <br /> the "Applicants") a the owners of the property located at 20 Orono Orchard Road N within <br /> the City of Orono(h reinafter"City")and legally described as follows: <br /> Lot 13, Block 1, Orono Oaks, Hennepin County, Minnesota (attached) (hereinafter "the <br /> 20 Parcel"); 4nd <br /> WHEREAS, the Applicants are also the owners of the property located at 30 <br /> Orono Orchard Rod N within the City and legally described as follows: <br /> Lot 10, Bloci 1, Orono Oaks, Hennepin County, Minnesota (hereinafter"the 30 Parcel"); <br /> and <br /> WHEREAS, the Applicants have submitted an application for a lot line <br /> rearrangement involving the 20 Parcel and the 30 Parcel which would relocate the lot boundary <br /> line between the pr perties; and <br /> WH REAS, in July 2002, Resolution No. 4836 was adopted by the City Council <br /> and granted appro al to the 30 Parcel for the keeping of 3 horses on the 30 Parcel where <br /> adequate pasture a reage to support 3 horses did not exist; and <br /> WH REAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.358 t. seq. and the City of Orono Zoning and Planning Codes, the Orono <br /> Planning Commiss n held a public hearing on the lot line rearrangement on November 18, <br /> 2013 at which time all persons desiring to be heard concerning this application were given the <br /> opportunity to spea thereon; and <br /> Page 1 of 3 <br />
