A conditio11al use permit is not required for the pond as it would not be constructed <br />within 51 of a lot line, would not be located in the 01 to 75' lakcshore setback and would not <br />alter more than 500 cubic yards of earth according to the applicant. Since tht:se standards <br />are met, this project can be undertaken with a staff issued permit. The ponds shown on the <br />drawings were conceptual and do not accurately re11ect the applicant's latest proposal. The <br />neighbors to the south have expressed concerns about the possibil.ity of breeding mosquitoes <br />in the standing water. The applicant has stated the pond would normally be dry. <br />STAFF RECOMMENDATION <br />Staff recommends denial of a variance of 4.8% hardcover in the 75' to 250' setback to allow 29.8% <br />hardcover where 25% is allowed.
