City of ORONO <br />Vim RESOLUTION OF THE CITY COUNCIL <br />NO. <br />G. The three watercraft allowed pursuant to this Resolution <br />may be owned only by Rhode, <br />o I- subject property 1,egallyMde:�criba&-ia..the_r; le. <br />this reS�lj,pn, or the two present easement holders, <br />Gregg Hannah and Darrell Stewart, or their successors in <br />title to property legally described as Tract I, R: 269 <br />and combined Tracts G & H, RLS 269 respectively. <br />ii. This resolution does not grant anv continuing or vested <br />right in Rhode or the present or future easement holders <br />to maintain or utilize the clock except in compliance with <br />the terms and conditions of the annual license and all <br />other applicable City or LMCD ordinances. <br />II. GRANTING THE VARIANCES <br />Based upon the above findings of fact and contingent upon <br />specifically those items as noted in Paragraphs A through H, <br />the City Council ('" the City of Orono grants the following <br />variances: <br />1. A variance to Section 34.452 as to lot size and width <br />with respect to the lot commonly known as 1410 Bohns <br />Point Road. <br />2. A variance to Section 34.202 as to maximiun permitted <br />hardcover to the extent of 3% such that no more than <br />5,520 s.f. of hardcover consisting of house, driveway, <br />sidewalk, deck, patio or any other impermeable surface <br />may be erected or maintained on this lot, and that all <br />such hardcover shall be located beyond 75 ft. from the <br />sh,)reline of Lake Minnetonka. <br />3. An interpretation that lin(- D-D as designated on Exhibit <br />A constitutes the average lakeshore setback line of <br />Section 34.201 which line protects the lakeshore views <br />from the Becker house. <br />(A) That the Rhode house and all appurtenances thereto <br />be constructed entirely behind line D-D, being no <br />closer to the lakeshore than line D-D, except as <br />follows: <br />1. An open, unscreened, unroofed, uner,,:losed <br />balcony as shown on Exhibit A, not to exceed <br />30 ft. long, 5 ft. wide or 150 sq. ft. in area, <br />may encroach ahead of line D-D a distance not <br />to exceed 5 ft. from line D-D. <br />PAGE _._1`OF - /_-, <br />
