HECKER <br />3146 NORTH SHORE DRIVE <br />WAYZATA MINNESOTA 56391 <br />55323 <br />I recently attended a meeting of the Planning Commission at which <br />Jack Rhode, thn owner of a lot adjacent to my property at 3145 North <br />Shore Drive, presented plans to build a house on the property. At <br />this meeting the Commission came very close to voting in favor of al- <br />lowing him to build a house nearly adjacent to mine. Had this loca- <br />on been approved, it would have been in violation of Zoning Ordinance <br />32.201 as well as the variance granted by the Planning Commission and <br />City Council on October 15, 1974, and October 22, 1974, respectively. <br />I have carefully read the pertinent sections of the Zoning Code of the <br />City of Orono and know that it is the intention of the Code to protect <br />property owners, such as myself. For example, the ;ode specifies that <br />the effect on values and property in the surrounding area will be taken <br />into consideration before variances are issued (32.240). The Code talks <br />about the need "to protect adjacent property" (32.240)(e). ThE Code <br />refers to the "disastrous affects of intense residential development <br />within the City of Orono" and about the guiding principle of "avoiding <br />the ill --effects of over -crowding" (30.030). The Code talks about "undue <br />concentration of structures" (30.030). Further, the Code says that ex- <br />isting lots of less than one acre with sewer may be utilized for single <br />family dwelling purposes with(, Council approval if the area i, within <br />80 of the requirements of the Zoning Code (31.202). The Code says that <br />a variance may not be granted as a "convenience" out only to alleviate <br />"demonstrable hardship or difficulty" (31.340). <br />My basic problem with respect to the home I purchased on September 4, 1?14, <br />can be summarized as follow3: <br />
