City of ORONO <br />RLSCLJTION OF THE CITY COUNCIL <br />NO. <br />6. The City Council has considered this application including the <br />findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicant and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />7. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger Lo neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demon- <br />strable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in }.seeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Eased upon the above findings, the Orono City Council hereby <br />grants a variance to the Municipal Zoning Code Section 10.22, Subdivision 2 <br />to permit the construction of a deck at the main floor level of the <br />residence per Exhibit A attached, which deck consitutes hardcover in excess <br />of the 25% hardcover allowance in the 75-250' lakeshore se�back zone, <br />subject to the following conditions: <br />1. The deck sha 1 1. be located as shown in Exhibit. A attached and shall <br />not be enclosed, nor shall it have a hand railing that exceeds the <br />standard 36" height above the deck platform. <br />2. App'_icant shall remove the following areas of existing hardcover <br />on the property, by removing the plastic sheeting underlying the rock <br />beds: <br />Zone Item and S.F. (See Exhlb'.c A) <br />T57--500' 360 s.f. Plastic under roc eds either side of south <br />driveway <br />75-250' 480 s.f. Along south side fence <br />75-250' 420 s.f. Along inside of driveway lo,jp <br />75-250' 200 s.f. Northwest of garage <br />3. Maximum allowable hardcover on the property shall be as follows: <br />rage 2 of 5 <br />
