RESOLUTION OF THE CITY COUNCIL <br />NO. <br />?1 RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAI, ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #1106 <br />WHEREAS, R.F. Potas (hereinafter "the applicant") is the owner of <br />the property located at 2190 Shadywood Road within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lots 14 and 15, Block 1, Wiley's Park Lake Minnetonka, Hennepin <br />County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.22, Subdivision 2 to permit the <br />construction of a deck at the main floor level of his residence, w'1ich deck <br />will constitute additional structural hardcover in the 75-250' lakeshore <br />setback zone in which the property already exceeds the 25% hardcover limit. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This i.cation was reviewed as Zoning File 41106. <br />2. The p, ty is located in the LR-IC Single Family Lakeshore <br />Residentiai _-niny District. <br />3. The Orono Planning Commission reviewed the applicant's original <br />proposal on February 17 and Marc;, 16, 1987, which proposal included a <br />deck and an enclosed parch which would have req•iired variances for <br />hardcover and for aver age lakeshore setback. On March 16, 1987, <br />Planning Commission voted 5-2 to der.v such variances. <br />4. The applicant or. April 8, 1987 revised his request to construct <br />only a deck at the main f loor level , such deck to extend only 15' <br />toward the lake from the existing house, thereby not encroaching on <br />the average lakeshore setbacy as iefinEd by the existing decks on the <br />two adjacent properties. ,uch deck considered as a non. -encroachment <br />per tiunicipal :..onira code Section 1C.03, Subdivision IS, (C). <br />5. The propoF.ed deck comprises 76 i s.f. of new structural hardcover <br />in the 71-25P' lakeshore setback zone which currently contains 46.7% <br />hardcc,vc r where only 25,, is normally allowed. Applicant proposes to <br />remove 1,100 s.f. of existing hardcover in the 75-250' zone, resulting <br />in a ntt in 75-250' hardcover of 537 s.f. for a final 75-250' <br />hardcov,_,r of 43.7P.
