(Above Space Reserved for Recording Data) <br />COMMON INTEREST COMMUNITY N0.2238 <br />Condominium <br />ORONO GARAGE CONDOS <br />DECLARATION <br />This Declaration (the "Declaration") is made in the County of Hennepin, State of Minnesota, on <br />January 14, 2026, by Orono Garage Condos LLC, a Minnesota limited liability company (the "Declarant"), <br />pursuant to the provisions of Minnesota Statutes Chapter 51513, known as the Minnesota Common Interest <br />Ownership Act (the "Act"), for the purpose of creating Orono Garage Condos as a condominium under the Act. <br />WHEREAS, Declarant is the owner of certain real property located in Hennepin County, Minnesota, <br />that is legally described m Exhibit B attached hereto, and Declarant desires to submit said real property and all <br />improvements thereon (collectively the "Property") to the Act as a condominium, and <br />WHEREAS, Declarant desires to establish on the Property, a plan for anon -residential development, <br />to be owned, occupied and operated for the use, health, safety and welfare of the Owners and Tenants of the <br />Property, and for the purpose of preserving the value, quality and character of the Property, and <br />WHEREAS, the Property (i) is not subject to an ordinance referred to in Section 51513.1406 of the <br />Act, governing conversions to common interest ownership, and (ii) is not subject to a master association as <br />defined in the Act; and <br />WHEREAS, the common interest community does not include shoreland as defined in Minnesota <br />Statutes Section 103F.205. <br />THEREFORE, Declarant subjects the Property to this Declaration under the name "Orono Garage <br />Condos," consisting of the Units referred to in Section 2, and declaring that this Declaration shall constitute <br />covenants to run with the Property, and that the Property and any real estate added thereto shall be owned, used, <br />occupied and conveyed subject to the covenants, restrictions, easements, charges and liens set forth herein, all <br />of which shall be binding upon all Persons owning or acquiring any right, title or interest therein, and their heirs, <br />personal representatives, successors and assigns. <br />5 <br />
