The property being developed has retained its natural character with an <br /> undisturbed wooded shoreline,which the developer has demonstrated a commitment to preserve by <br /> granting a woodland preservation easement. While this property was initially intended to be served <br /> by septic systems,the City Council concluded in March 1998 that preservation and protection of the <br /> natural features of the site and the Bay would be best accomplished by providing sewer to this <br /> development,with no increase above the density that could be accomplished using septic systems; <br /> and <br /> WHEREAS, the City Council subsequently directed that staff draft a <br /> Comprehensive Plan amendment incorporating the entire shoreline of Maxwell Bay within the <br /> MUSA because the ability to provide sewer if additional lakeshore development occurs,or if existing <br /> systems become a problem, will help to ensure the long-term protection of Lake Minnetonka; and <br /> WHEREAS,pursuant to legal notice,the Orono Planning Commission held a public <br /> hearing on the proposed amendment on May 18, 1998 to receive public comments regarding the <br /> • proposed amendment, at which time all public comments were heard; and � <br /> WHEREAS, the Orono Planning Commission on May 18, 1998 recommended <br /> approval of the proposed amendment on a vote of 5 to 0; and <br /> WHEREAS, on May 26, 1998,the City Council reviewed the draft amendment and <br /> directed staff to submit the amendment to Metropolitan Council; and � <br /> WHEREAS,on June 26, 1998 Comprehensive Plan Amendment#7 was submitted <br /> to the Metropolitan Council for approval and written notice was sent to surrounding local units of <br /> government and other affected jurisdictions requesting written comment; and <br /> WHEREAS,no negative comments were received from the surrounding local units <br /> of government or other affected jurisdictions; and � <br /> WHEREAS, on July 2, 1998 the Metropolitan Council completed its review of <br /> � Comprehensive Plan Amendment#7 and determined that the proposed amendment is consistent with <br /> the Regional Blueprint, including the Regional Growth Strategy, and in conformance with <br /> metropolitan system plans; and • <br /> WHEREAS,on July 2, 1998 the Metropolitan Council indicated to the City via letter <br /> � <br /> Page 2 of 3 <br />
