City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2196 <br />WHEREAS, Lot 2 contains a portion of a pond that is a Designated <br />Wetland and for which a Conservation and Flowage Easement is required; and <br />WHEREAS, the existing house and garage on Lot 2 conform to all <br />required yard and setback requirements, and a house can be constructed on <br />Lot 1 that will meet the required 301 side (north and south) and 50' front <br />(east) yard and setback requirement; and <br />WHEREAS, the subdivider has completed all requirements of the <br />platting regulations of the City, including: <br />1. Completion of all the requirements of Resolution No. 2166. <br />2. Creation of a new private road right-of-way shown on the plat as <br />Outlot A, for future use as private roadway. <br />3. Concurrent with the creation of this Outlot, the Subdivider has <br />dedicated to the City a Road and Utilities Easement granting to the <br />City permanent access, improvement and uti lit} easements over said <br />Outlot; the Subdivider has created non-exclusive ingress, egress, <br />drainage and utility easements over said Outlot in favor of all <br />abutting and/or benefiting lots including a declaration of certain <br />maintenance covenants wherein each of the abutting and/or benefiting <br />lot owners covenants and agrees to permanently maintain and pay the <br />cost of maintenance for said private road. <br />4. Dedication to the City of a Flowage and Conservation Easement <br />providing for limitations on the use of wetlands and/or drainageways <br />described therein and occurring within Lot 2. <br />5. Payment to the City of fee for the legal review and filing of the <br />plat easements and covenants in the amount of $150.00. <br />NOW, THEREFORE HE IT RESOLVED, that the City Council of the City <br />of Orono hereby approves the plat of Lauranne Woods, Hennepin County, <br />Minnesota; subject to the following conditions: <br />1. A variance is hereby granted for Lots : and 2 which do not front <br />on a public roadway as required. <br />2. A variance is hereby granted to the 200' lot width standards for <br />Lots 1 and 2. <br />3. The road outlot for future roadway use shall be privately owned <br />and maintained per the Declaration, of Private Road Easement and <br />Declaration of Covenants for Maintenance of Same executed by the <br />developer. <br />Page 2 of 3 <br />
