Zoning File #1080 <br />March 9, 1987 <br />Page 6 <br />The northern dry land portions of the Burger's, Maus' and Miner's <br />properties would remain at the five acre density. Based on the current <br />unsewered LR-lA standards, there would be no change in densities within the <br />developed southern parcels. Remember Miners' property is made up of 3 <br />independent parcels each with a residence structure. <br />The overall effects of the proposed rezoning on t' ixisting properties <br />would be ne,ligible. The City on the other hand % gain because now it <br />would have the environmental controls needed o% such sensitive land <br />areas. Remember the LR districts have the only standards to control the <br />degree or the intensity of development - Lhe hardcover standard. <br />Mr. McDowell has released all interest in the application as amended by <br />staff. Prior to Planning Commission action, staff sent written notice to <br />each of the affected land owners advising them of the City's intenL (See <br />Exhibit O). The neighbors no longer object because the undeveloped <br />northern area of the parcels remain in the RR-1A, five acre minimum area <br />zone. There will be no change in density within the southern dry buildable <br />area. <br />Planning Commission Recommendation - <br />To recommend that. the land within 1,000 feet of the shoreline of Lake <br />Minnetonka involving the James Maus property at 3700 Bayside Road, the <br />John Burger property at 3750 Bayside Road, the Hazel Anderson property at <br />37Pr yside Road and the Miner properties at 3820, 383C and 3860 Rayside <br />Rr rezoned from RR-lA, Rural residential Zoning to LP,-lA Lakeshore <br />F ,dential 'oning, based on the following findings: <br />1. P(-: Section 10.10, Subdivision 3 - Required findi.nss f,-)r Rezoning <br />- The proposed rezoning "would be in the best interest for the <br />physical development of the Zity." <br />2.. Per Section 10.23, Subdivision 1 - The Intent of the LR-lA <br />District - The current use Ind development of the properties are <br />consistent with the desired low de;isity residential development and <br />limite3 agricultural activity. The controls of the district will <br />strengthen the City's ability to protect and preserve an <br />environmentally sensitive area. <br />3. Per Comprehensive Management Plan 3-18, Environmental Protection <br />Goals - The proposed rezoning will assure that the Environmental <br />Protection Goals of the City are realized. <br />4. Per Comprehensive Management Plan 3-20 - Policy Statement No. 8 - <br />The proposed rezoning will provide the appropr.ate regulat.ons to <br />reasonably control building density, land alteration and lakeshore <br />encroachment. <br />
