Staff <br />is aware of no such current use. <br />5. WhAt is the probability of future use of the rights of way for <br />access, utilities or other public use? The rights of way <br />apparently serve only three parcels: <br />a) These lots 1-10, already combined as one tax parcel: <br />Access from the lake would not be affected by vacation. <br />b) The Faus parcel to the west: This parcel has direct <br />access to the lake. <br />c) The Erickson parcel to the north: This parcel has <br />direct access to the lake (channel) without requiring <br />access through wetlands. the parcel is connected to <br />other Erickson parcels to the north which also have <br />direct access. These rights of way are the only Erickson <br />access to this shore of the island but Erickson is on <br />record as favoring vacation. <br />6. If the rights of way were vacated in return for consolidation <br />into one parcel of equal land area, what purpose would or <br />could be served? This could include maintenance of access <br />rights and/or maintenance of public property rights. <br />7. Is the property buildable without vacation? Perhaps a house <br />could be located in one area (lots 9 & 10 for instance) with <br />a lot area/width variance in return for open space easements <br />over remaining lots. Net effect same as vacation with relocation <br />of rights of way. <br />8. What public benefit is served by vacation? <br />a) Public (Park Reserve) gain by furthering the District's <br />land trade and consequent consolidation of holdings. <br />b) Pro-jides buildable site (as in 7 above) without rights <br />of way restrictions: Building site increases by X amount <br />the taxable valuation. <br />c) Transfers ownership and caretaking responsibilities to <br />private sector thereby reducing city liability for future <br />maintenance. <br />
