City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2398 <br />D) The location of the neighbur's house is at the east side <br />property line. The garage in its proposed location will lessen <br />the impact on the neighbor to the east. <br />E) Moving the garage further north provides the much needed <br />turning around area between the t ouse and garage to lessen the <br />hazards of backing out onto the public roadway, and decreases <br />the element of hazard. <br />F) There is no visual impact along the County road because of <br />the mature dense screening that exists along the roadway and the <br />garage will be installed so as not to destruy the existing <br />screening. <br />4. The City Council has considered this application in-luding the <br />findings and recommendationE of the Planning Commission, reports by <br />City staff, comments by the applicant and the effect of the proposed <br />variance on the health, safety and welfare of the comnunity. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demon- <br />strable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />COLICLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono <br />City Council hereby grants a variance per Municipal Zoning Code Section <br />10.03, Subdivision 9 (C) and Section 10.24 Subdivision 5 (B) to permit <br />the construe-tion of an accessory structure by 86 square feet and located <br />-ip& feet from the right-of-way line of North Shore Drive, subject to the <br />fo1low inc, conditions: <br />1. The applicant is to obtain a land alteration permit for the <br />regrading of the drive and the placement of the retaining walls <br />adjacent to the drive. <br />2. The applicant must obtain a demolition permit for the <br />removal of the existing garage and shed. <br />Page 2 of 4 <br />
