TO: Paul acherber/D. Carlson
FROM: Al"n P. Olsen, Village Planner
DATE: November. 1, 1979
SUBJECT: #508 Subdivision - 1420 Bohns Point Road
PRELIMINARY APPROVAL CONDITIONS
1. Two (2) lot subdivision ,jar July 20, 1979 survey.
2. Smaller lot (1) is not riparian and +x not to have any easements
or other lake access rights.
3. Larger lot (2) is riparian to lake Minnetonka.
4. Existing 25 ft. easement across north edge of property is to
remain in effect, but purpose of easement is to be clarified by
the applicant. The 5 easement copies given to the City to date
AO NOT include the original easement(*) from the owner of this
property to any other, they only further transfer existing
easement rights.
S. Existing driveways provide adequate access. Any mutual use
casement is a private matter not requiring City review.
6. The shed located on the proposed dividing line is to be moved
or removed for a minim:un 10 ft. setback.
7. Bohns Point Read is to be dedicated.
8. Park fear is to be waived.
9. The 3olomonson encroachment is to be researched further. Sep+
my letter to them attached. With this encroachment there is a
title defect which must be cleared. The best method is to
actually sell a piece of land to the neighbor to provide at least
a minimal setback. This could be platted in at the time of the
subdivision in an expeditious manner.
PHYSICAL IMPROVEMENTS
The only work involved is to remove or, relocate the small shed located
on the proposed division line. This must be moved one way or the other
to provide at least a 10 fuot setback prior to final plat approval.
No permit is required for this work.
