Tbepark tee should not be charged as there is <br />an existing dwelling on both lots. <br />2. Each lot has separate, actually existing access. <br />Any mutual easement for reciprocal use should <br />be a private matter of no concern to the City. <br />3. fir. Lauer's concern for the easement across the <br />north part, of the property in natural. The <br />easement is developed ae a gravel drive and <br />though poorly maintained, is a aerondary access <br />to the Lauer property. I would suggest requiring <br />this easement to be platted as an outlot so the <br />access will be visible on the plat and will be <br />less likely to be encroached upon in the future. <br />The City could ignore the easement and assume <br />that it will carry through with validity, but <br />the outlot method will assure the intent of the <br />easement in providing accoss to the otherwise <br />land -locked Lauer lot. <br />4. The encroaching shed is of minimal valise an(l <br />easily moved and/or removed. <br />5. The most serious question was apparently not <br />discussed by the Planning Comminsion. The <br />neighboring house at 1480 Bohns Point Road is <br />shown as encroaching on this ,property. We have <br />a survey on file showing a 50' setback for the <br />original construction in 1962, plus other permits <br />fnr a 24' X 24' addition and conversions without <br />surveys, but nothing to indicate such an encroach- <br />ment. <br />2,he Scherber's surveyor shoulu recheck and confirm <br />or elearup any eenrroaehment. <br />If there is encroachment, I suggent that at leapt <br />10' of side yard be platted and sold to the <br />neighbor to resolve this problem. Such a sale <br />would not adversely affect this property. <br />6.
