Lot Area: <br />Application Summary: Applicant requests a conditional use permit to construct a <br />detached accessory structure on a through lot, and a side setback variance to place a <br />25'x35' garage 20' from a street side yard setback where 35' is required. An accessory <br />building on a through lot requires a conditional use permit. The purpose of the <br />conditional use permit in this instance is to assure minimal visual impact on neighboring <br />properties and views from the road. <br />1. The proposed accessory structure would meet all other standards for this district. <br />Staff Recommendation: Staff recommendation: Planning Department Staff <br />recommends approval of the requested variance and conditional use permit provided the <br />following conditions are met: <br />1. Vegetative screen and privacy fence along Bohn's Point Rd are to be maintained. <br />2. Density of the vegetation on the lot be kept such that the visual impact from <br />County Rd 51 be minimized. <br />3. No access to Bohn's Point Rd for proposed garage. <br />Pertinent Zoning Ordinance Sections <br />✓ 10.03.10 Conditional Use Permit Required. All accessory buildings on <br />through lots located in "R" Districts shall require a conditional use permit. <br />✓ 10.03.9(D) Accessory Building Location: No detached garage or accessory <br />building shall be located nearer the front or street lot line than the principal <br />structure. <br />✓ 10.03.9(E) Accessory Building Setbacks : Accessory structures in excess of750 <br />s.f. footprint area shall be located at least 15 ' from any lot line. <br />✓ 10.03.12 Crowding Principal Building: No accessory structure may be located <br />within 10' of the principal building. <br />✓ 10.09.6(A)(3) Granting of a CUP: The proposed conditional use will comply <br />with each of the applicable provisions of the Zoning Chapter. <br />✓ 10.24.5(B) Lot Requirements: Side yard setback adjacent to street shall be 35'.
