City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. _ 2233 <br />A RESOLUTION VACATING <br />AN UNUSED PORTION OF A <br />DEDICATED DRAINAGE AND UTILITY EASEMENT <br />AT 627 AND 629 NORTH F11121DALE ROAD <br />WITHIN THE PLAT OF LAUIRIMT ADDITION <br />SECTION 36, TOWNSHIP 11u", RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 1170 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, on June 26, 1987, Tea Q. Feig and Timothy D. Johnson <br />filed a petition with the City of Orono requesting vacation of a portion of <br />drainage and utility easements originally dedicated within the plat of <br />Laurent Addition, legally described as follows: <br />An easement for drainage and utility purposes as shown on the recorded <br />plat of LAURENT ADDITION, being 5 feet on each side of the Easterly <br />and Southerly lines of Lot 1, Block 1, LAURENT ADDITION, not including <br />that for -ion of the 10 foot drainage and utility easement adjoining <br />the Northerly lines of. Lots 1 and 2, and not including that portion of <br />the 10 root drainage and utility easement adjoining the westerly lines <br />of Lots 1 and 2. <br />WHEREAS, after due published and posted notice, a public hearing <br />was held before the Orono Planning Commission on July 20, 1987, regarding <br />said vacation ,and all persons interested were giv^n an opportunity to be <br />heard; and <br />WHEREAS, after due standing and consideration, the Planning <br />Commission recommended approval of the requested vacation and the Council <br />of the City of Orono finds that said vacation, as proposed, is in keeping <br />with the public interest in consideration of the following findings: <br />1. The vacation does not affect access to or use of any adjoining <br />property. <br />2. The City has not and does not intend to develop, improve or use <br />the portion of dedicated drainage and utility easement described <br />above. <br />3. The portion of dedicated drainage and utility easement as it <br />exists serves no public purpose. <br />4. The portion of dedicated drainage and utility easement, as a <br />result of a concurrent lot line rearrangement no longer coincides with <br />the boundary between the properties at 627 and 629 North Ferndale <br />Road. <br />Page 1 of 2 <br />
