Work Elements for the Plan <br />The contractor will: <br />1. Accumulate documentation on overlapping authorities. <br />2. Review and evaluate formal and informal communications processes to <br />determine if improvements are possible. <br />3. Evaluate the need and make recommendations concerning a more formal <br />relationship between the agencies most active in managing the lake's <br />water surface. <br />Institutional Arrangeents <br />Definition: This includes the analysis of the existing structure of the LMCD, <br />its powers and authorities and membership and how that entity re- <br />lates to higher and lower authorities as well as the power neces- <br />sary to adopt, implement and enforce the plan. <br />Backgroand: <br />The LMCD has prepared a legislative package to be presented to the next legisla- <br />ture to make certain changes in its authority and scope of interests. The two <br />Task Forces have recommended that this issue be investigated. <br />Presently, the LMCD has authority over the lake surface and docks along the <br />shoreline. That authority is shared by largely overlapping programs by the <br />DNR. The Watershed District and the DNR have permitting authority over con- <br />struction in the lake and developments affecting the lake. The LMCD, Water <br />Patrol, Hennepin Parka, Metropolitan Council and ONE have all collected recre- <br />ational use data. <br />Presently, the municipalities have sole authority over developments on land, un- <br />less there is construction in the water. LMCD has only the power to recommend <br />a course of action to the local authority. <br />Sw a municipalities have passed ordinances that duplicate, or nearly duplicate, <br />LMr,D and Watershed District rules and regulations. Others have passed few, if <br />any. Accordingly, there are differing levels :f protection of lake nei lake- <br />ahnre renuurce.. <br />Various parties hale recommended changes to the existing institutional arrange- <br />�aents. Some increase LMCn power; others decrease it. Some decrease the power <br />,t the DNg; no one has suggested increasing it.
