Mabusth, Zoning Administrator <br />February 4, 1987 <br />Subject: Zoning Amendment - Off -sale Liquor Store use added as permitted <br />use (B-1 and B-3 Districts) and public service structures <br />approved with public impro•ements projects would not require <br />conditional use permits. <br />A. Off -Sale Liquor Store Use, Section 10.40, Subdivision A <br />The proposed amendment would allow an off -sale liquor store use in the <br />two most compatible commercial districts - B-1, Retail Sales and Services <br />Business District and B-3, Shopping Center Business District. The <br />commercial lakeshore, commercial office and neighborhood commercial <br />e •tricts have been deemed unsuitable for such use. <br />An amendment for the licensing of private off -sale liquor stores is <br />currently being considered by the Council. The proposed licensing <br />standards were also reviewed by the Planning Commission. <br />In addition, staff has contacted the cities of Golden Valley, <br />Plymouth, St. Louis Park, Minnetonka and Crystal to determine how their <br />zoning codes address off -sale liquor store use. All confirmed that the <br />licensing code sections covered any special considerations or standards for <br />the use and that off -sale liquor store use is a permitted use in specific <br />commercial zoning districts. <br />Planning Commission felt the licensing standards were adequate and in <br />the minutes of January 20, 1987, recommended that off -sale liquor use be <br />added as a permitted use in the B-1 and B-3 zoning districts. Section 4 of <br />the enclosed ordinance has been drafted per the recommendation of the <br />Planning Commission. <br />B. Public Service Structures, Section 10.20, Subdivision 3 (D) <br />The Planning Commission considered an amendment of the section that <br />would require a conditional use permit review for all public service <br />structures. The proposed amendment would exempt public service structures <br />reviewed and approved before the public at the required public hearing for <br />all public improvement projects. Amendments of these plans involving <br />changes in design and/or placement of these structures would require <br />written notice to all affected property owners prior to the formal adoption <br />of the amended plans by the City Council. The Planning Commission felt <br />that the written notice procedure appears less burdensome on the <br />planning/implementation process in consideration of the time required for a <br />conditional use permit. The Planning Commission specifically asked that <br />any change in design and/or placement be reviewed again by the affected <br />public. Section 3 of the enclosed ordinance haq been drafted accordingly. <br />PROPOSED MOTION: Moved by , seconded by , to approve Ordirmncn No. <br />amending Zoning Code Sect -on 10.20, SubdivMon 3 (D) that would exempt <br />public service structures approved with public improvement projects from <br />the requirement of a conditional use permit and Section 10.40, Subdivision <br />A by allowing off -sale liquor stores as permitted uses. <br />
