Zoning File 11100 <br />February 6, 1987 <br />Page 2 of 2 <br />Staff Recommendations <br />As a result of further discussions with the City Attorney and in <br />attempting to not stray too far from the intent of the Code, staff now <br />proposes a slightly different mode of approval, as follows: <br />1. The conditional use permit for a guest house use is granted on a <br />permanent basis. <br />2. A Certificate of Occupancy will be granted when the guest house is <br />complete and ready for occupancy as a guest house. <br />3. There will be no time limit set for completion of the anticipated <br />subdivision; however, the conditional use permit approval resolution <br />will contain the advisory (to be acknowledged by applicant) that he is <br />liable for the completion of the subdivision prior to any dual - <br />principal -dwelling use on his property (i.e. if he .noves into the new <br />house, he cannot rent his old house and vice -versa). <br />4. Some form of security, be it letter of credit, bond, or ? will be <br />required to be filed with the City, to be forfeited as a penalty if <br />rental or other dual -principal -dwelling use occurs prior to <br />subdivision completion. Such use shall be considered to occur at such <br />time that the second structure on the property is occupied for more <br />than one month by any person(s) other than a non -rent paying relative <br />or a non -rent paying full-time employee of the applicant. <br />5. The City is under no obligation to approve a subdivision of the <br />property solely based on the issuance of this conditional use permit. <br />6. Applicant will be responsible for obtaining a temporary access <br />permit from the Public Works Department in order to move the structure <br />onto the propoerty. Such permit shall be granted subject to <br />appropriate drainage and traffic controls being provided as determined <br />by the Public Works Department. The duration of such permit may he <br />limited or extended at the discretion of the Public works Coordinator, <br />but in no case shall exceed a period of 2 months. After that access <br />permit expires, all a,.cess for constr,,-lion and use of the guest house <br />shall be via the applicant's existing driveway. <br />The above conditions have been incorporated into the attached <br />conditional use permit resolution for Council's review. <br />
