OCT 27 2004 12:20 PM FR HINSHAWCULBERTSONLLP334 8888 TO 1461ij7048395ij952 P.03 <br />In preparing the title opinions it was discovered that the Johnson parcel, Lots 7 and 8, <br />was actually owned not just by Mr. Johnson, but by him (half interest) as tenant in common with <br />his 5 children (one tenth interest each.) Mr. Johnson had deeded one half the property to his <br />children in connection with some estate planning done a number of years earlier. <br />So, the Brysons and Mr. Johnson and his five adult children (and their spouses) would <br />like now to complete the lot line rearrangement. In reviewing the approving Resolution it <br />appears the items listed below are required. With each I give a brief status report. <br />a. Title Opinions -done in December '02 ~ will update. <br />b. Certified copies of all recorded easements -there is just one -I wilt obtain a <br />certified copy. <br />c. 3 copies of a Certificate of Survey-the enclosed survey is being updated by <br />MFRA to, among other things, add the names oftbe additional owners of Lots 7 <br />and 8 -Mr. Johnson's 5 children and their spouses. / would like your approval <br />in advance of the certification on the survey so we only have to execure this <br />once. <br />d. Agreement to Extinguish Easement -a draft is enclosed. <br />e. 2 Quit Claim Deeds -drafts are enclosed <br />-Lot 5 to Brysons <br />-Lot 6 to J. Johnson. <br />f. J. Johnson Quit Claim Deed of Lot 6 to his children-establishes common <br />ownership of I,ots 6-8. <br />g. 2 Drainage And Utility Easements - <br />-Brysons grant Lots 3-5 easement <br />-Johnson, et al, grant Lots 6-8 easement. <br />Please call me after you have had an oppmtunity to review these materials. We would like to <br />complete the lot Jine rearrangement soon.
