Fire Code Issues <br />The City does not allow structures to be located this close to a property line without meeting strict <br />fire code standards. It is recommended by Staff the cabin on Lot 5 be removed prior to the City <br />filing the Subdivision with Hennepin County. Both the cabin and shed are located well within the <br />required 30' side yard setback. <br />City Building Official, Lyle Oman has included a memo to explain the requirements for structures <br />on property lines. Because the requirements are from the State Building Code, Cities do not have <br />the right to grant variances from these standards. Therefore, in order for this subdivision to be <br />approved the lot line must be moved to allow proper building setbacks or the cabin on Lot 5 shall <br />be removed from the property prior to filing the subdivision. <br />The Planning Commission recommendation was to approve the subdivision of a lot line <br />rearrangement, allow the cabin to remain for 30 months after Council approval and to disconnect <br />services to the building. <br />Setbacks as determined in the RS Zoning District for internal and rear property lines: <br />Lot width 200 feet or greater --50 feet <br />100 feet, but less than 200 --30 feet <br />less than 100 feet --10 feet <br />Items for discussion <br />1. Section 10.31, Subdivision 6 (C) (1) states lot line rearrangements between abutting <br />properties that do not create an additional building site will normally be approved. <br />2. The rearrangement will place two cabins on one lot. The Code does not allow more than one <br />cabin on a lot without granting variances and a conditional use permit. <br />3. The 670 Big Island property shares a septic system with the adjacent cabin that would be <br />removed. All easements and agreements would be vacated at that time. <br />4. The well and septic for the 650 Big Island property are located on another property that <br />would be combined with 650. The entire septic and well would now be on one lot. <br />5. The cabin on Lot 5 would be located approximately 1.5 feet from the lot line. Staff is <br />recommending removal of the cabin. The applicant has stated his intent is to remove the <br />cabin. <br />6. Any drainage and utility easements that are located along the interior lot lines should be <br />vacated. The City would require drainage and utility easements 5' along interior lot lines and <br />1 O' along the rear lot lines. <br />#2461 Christopher J.
