112086.2 <br />TO: [layor and City Council <br />FROM: mark Bernhardson, City AdminL tratorl <br />DATE: November 20, 1986 <br />SUBJECT: Solid Waste <br />ISSUE - Council directing staff to work towards the development of a <br />joint powers agreement with neighboring communities for handling of <br />recycling specifically and possible solid waste collection generally. <br />DISCUSSION - As you are aware Hennepin County has mandated a 16% <br />recycling goal over the next few years in conjunction with major <br />changes eliminating land fills and the burning of non -recyclable solid <br />waste. Hennepin County's work is in response to mandates by the State <br />for the closing of land fills. The Council has recognized the need <br />for work on the solid waste area by the community through its key <br />strategic objective #2 in the Strategic Planning document. There are <br />a number of issues in the draft that the City would recommend being <br />addressed. These include: <br />- Joint Powers Scope <br />- Development versus operation <br />- Solid waste collection plus recycling <br />-;Addition of new members <br />- Capital/Initial funding mechanisms <br />- Language on withdrawal <br />-�,Notice requirement <br />—Obligations on withdrawal <br />n Ration of assets <br />Whilc staff sees the merit of having a policy type body on a joint <br />powers basis for the start and implementation as their significant <br />policy issues, the ongoing operation of the system is probably best <br />done in a contractual arrangement of one the communities contracting <br />the service with the others as the system operation is not a long term <br />policy problem but more an operation problem. That can best be <br />handled by a contractual arrangement. <br />RECOMMENDATION - It is requested that the Council review issues raised <br />by staff and provide any feedback regarding the recycling and possibly <br />solid waste co.1_lection issue generally that they would like to have <br />incorporated in the development of such an agreement. Staff feels <br />that a joint powers is a recommender] means to accgmplish this however, <br />feels there is si,nifican' need to amend the cur ent_ contents of the <br />agreement to address the above issues. <br />PROPOSED P10TIUN - Moved by , seconded by , the Council direct <br />staff to incorporate any changes it feels appropriate in the direction <br />of the joint bowers agreement. fives L% Jnv.-, /. <br />
