I •' <br />· EXCEPTION:\ Upon notice/of reco;d lot classification <br />pursuant to Subparag:i:.aiS'h A of Subdivision 6 and within <br />six months of~fective date of this Section, any <br />record lot owner may apply to the Council with no appli- <br />cation fee required for a variance to this Subdivision to <br />allow continued non-conforming use, subject to reasonable <br />standards and timetables, established by the Council for <br />compliance with on-site sewage treatment, private <br />security, private fire protection and other performa~~~ <br />standard requirements -established by this Section. The <br />applicant shall demonstrate and the Council shall find <br />that the use is and was legally existing as of November <br />9, 1981, the effective date of moratorium Ordinance No. <br />238. Failure to apply for such a variance within the <br />time allowed shall be prima facie evidence that such a <br />non-conforming u~~ was either. ~llegal or did not lawfully <br />exist on thjlct:·date. .. <br />' ~ <br />Subd. 1( Non-Conforming Substandard Properties.\ <br />Restrictions appl}in__g_ to non-conforming uses shall not apply to 1 <br />r e co r d 1 o t s w h i ch a r e · ···s u bst;-anQ.a.r.d .... in._l.oJ:..._,.,a.r.aa.....o..r.. .. lG-t--w...i-d-t...fl---B-u-.t------,,1 <br />which are being used in conformance with this Section: <br />A. <br />dry-buildable lot <br />became substandard <br />Ordinance No. 172. <br />Record lots which are less than 2.0 acres in <br />area and/or less than 200 feet in lot width <br />lots on January 1, 1975, the effective date of <br />B. Record lots, which are greater than 2.0 acres in <br />dry-buildable lot area, but are less than 5.0 acres in dry- <br />buildable lot area, became substandard lots on the effective date <br />of this Section. <br />C. Substanda£c:i.rec-efi.'l lots may be used or developed <br />pursuant to Subpa~a ph"s-P·· and G of··-s~ubdi vis ion·o-:---------- <br />~- <br />Subd. 8. Non-Conforming Substandard Buildings or <br />Structures. Existing buildings not <br />conforming to the requi~ed minimum setbacks may continue to be <br />used, repaired or maintained within ~he existing building envelope. <br />These buildings may be enlarged vertically or horizontally within <br />the required yard area without requiring a Council approved setback <br />variance, provided: <br />A. The addition conforms to all required setbacks, <br />even if parts of the existing building do not; or,
