Gaffron, <br />Assistant Planning & Zoning Administrator <br />Date: August 14, 1986 <br />Subject: #1064 City of Orono - Spates Avenue Near County Road 15 <br />- Conditional Use Permit/Variance <br />Aoning District - LR-: A <br />Application - After -the -Fact Conditional Use Permit and Variance <br />For Lift Station <br />Pertinent Code Section: 10.20, Subdivision 3 (D) <br />Subdivision 3. Conditional ;jses. Within any "R-lA" One Family <br />Residential District_, no structure or land shall be used for the <br />following uses except by conditional use permit: <br />D. Public Service Structures. Public service structures, <br />including but not limited to electric transmission lines, <br />buildings such as telephone exchange stations, booster or <br />pressure regulating stations, wells, and plumbing stations, <br />elevated tanks, lift stations and electrical power sub- <br />stations, provided no building shall be located within fifty <br />feet from any lot line of an abutting lot in an "R" <br />District. Prior to granting such permit it shall be found <br />that the architectural design of service structures is <br />compatible to the neighborhood in which it is to be located <br />and thus will promote the general welfare. <br />Discussion: <br />The City was apparently remiss in not making a formal application <br />for Conditional Use Permit for the Crystal Bay Lift Station, based on <br />the code section presented above, which was pointed out to staff <br />after -the -fact. A review of City files indicates that this code <br />section has been in the Zoning Code since at least 1968, but we have <br />no record of any previous formal applications by the City for the ma', <br />other lift stations constructed since that time. It would appear th" <br />standard past procedure has been to approve these lift stations as <br />part of the public hearing review process for overall sewer projects. <br />
