91586.2 <br />TO: Mayor and City Council I <br />'J <br />FROM: Mark Bernhardson, City Administrator�';'i ` <br />DATE: September 15, 1986 <br />SUBJECT: Big Island Board of Governors <br />At your August 22, 1986 meeting the Big Island Board of Governors <br />presented concerns they had regarding the relationship between <br />the City of Orono and themselves. Based cn their request that <br />evening, their temporary conditional use permit for work on the <br />camp was extended to December 31, 1986. In conjunction with that <br />they did give us an updated certificate of insurance which runs <br />through September of '87. Additional issues raised that evening <br />were as follows: <br />1. Fish Houses The City Attorney had attempted to get <br />a pret a' "earing scheduled for September 2, 1986 but <br />problems -.th the Big Island Board of Governor's <br />Attorney that hearing has been delayed until September <br />17, 1986. The City did review the issue and it was <br />determined that only two citations had been issued to <br />both the property owners and to Roy's Bait Shop. This <br />is common practice as with most citations the Court <br />likes to see ongoing violations, as would be noted in <br />two citations. <br />2. Conditional Use Permits for Hiking Trails - The <br />reference made to statements by myself from the Big <br />Island Board of Governors were contained within a <br />December 5, 1985 letter that was sent to the Big Island <br />Board of Governors to address a number of other issues <br />and indicating what right they may have within their <br />existing uses. This issue was not raised during the <br />March meeting consideration of their application and <br />when mentioned at the September meeting was the first <br />awareness staff had that hiking trails were desired by <br />the Board of Governors. <br />3. Reconstruction Value - They had requested that the <br />Council reconsider the policy that required a zoning <br />variance when a building is more than 50% of the <br />contractors value and it is a nonconforming building <br />(which is the case of many of the buildings on Vet's <br />Camp are in a nonconforming status, particularily the <br />small cabins and the boat --louse.) They requested that if <br />volunteer labor was used only the actual expenditure to <br />fix it up be considered in determining the 50% value. <br />It is staff's recommendation that Council stay with the <br />50% contractor's value as outlined in the ordinance. An <br />amendment or other interpretation would allow the <br />property owner to fix up a nonconforming structure when <br />
