The existing garage is a unique condition for the area, given its <br /> height and location, built into the slope; and <br /> B 10. The granting of the application is necessary for the preservation and enjoyment of a <br /> substantial property right of the Applicant; the 30-foot setback applied to the garage <br /> presents a difficulty for the Owner to reasonably expand the size of the garage for <br /> interior storage. The granting of the variance is necessary due to the limitations of the <br /> site with the existing location of the garage and will preserve their property rights for this <br /> use; and <br /> B11. The granting of the proposed variance will not in any way impair health, safety, comfort or <br /> morals, or in any other respect be contrary to the intent of this chapter; the variance does <br /> not impact the health, safety, comfort or morals of owners or residents in the area. The <br /> intent of the increased rear setback for an oversized accessory building is better met with <br /> the building in its existing location being screened by the topography adjacent to the <br /> building, near the edges of the Property, and <br /> B12. The granting of such variance will not merely serve as a convenience to the Applicant, but <br /> is necessary to alleviate demonstrable difficulty; The granting of the variance is <br /> reasonable and would alleviate a difficulty placed on the Owner making an improvement <br /> to an existing building to reasonably use it for the interior storage of larger boats and <br /> trailers. <br /> CONCLUSIONS, ORDER AND CONDITIONS: <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance from Orono Municipal Zoning Code Section 6.12.1450 for a rear setback variance for a <br /> 240-square-foot addition to an existing detached garage 10 feet from the rear property line <br /> where 30 feet is required, subject to the following conditions: <br /> 1. Council approval is based on the entire record, above Findings. <br /> 2. The approved project shall conform to the building plans and survey submitted by the <br /> Applicant, attached to this Resolution as Exhibit A. <br /> 3. Any amendments to the plans which are not in conformity with City codes may require <br /> further Planning Commission and City Council review. <br /> 4. Authorities granted by this resolution run with the Property not with the Owner, but are <br /> permissive only and must be exercised by the issuance of a permit for the proposed <br /> addition and commencing construction of the project.
