gOiv. CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> 1. �I 1 I E: NO. 7659 <br /> l4kEs H O�`' <br /> a. The property owner in question proposes to use the property in a reasonable <br /> manner, however, the proposed use is not permitted by the official controls; the <br /> property is permitted an oversized accessory building, despite the location of the <br /> existing garage within the rear setback. The interior storage of larger boats and <br /> trailers is a reasonable use of the garage and property, and <br /> b. The plight of the landowner is due to circumstances unique to his property not <br /> created by the landowner; the building was constructed by a previous owner within <br /> the rear setback of the property; and <br /> c. The variance, if granted, will not alter the essential character of the locality; the <br /> building has been in its present location for at least 30 years, and an addition to the <br /> ground level only, where the increase in massing will be at a lower elevation that <br /> surrounding properties, is not anticipated to impact the character of the area. <br /> B4. Economic considerations alone do not constitute practical difficulties; economic <br /> considerations do not impact the finding of practical difficulties with the Property; and <br /> B5. Practical difficulties also include but are not limited to inadequate access to direct sunlight <br /> for solar energy systems. Variances shall be granted for earth-sheltered construction as <br /> defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with Orono City Code Chapter <br /> 78; this condition is not applicable to the variance; and <br /> B6. The board or the council may not permit as a variance any use that is not permitted under <br /> Orono City Code Chapter 78 for property in the zone where the affected person's land is <br /> located; oversized accessory buildings are permitted within the zone district. As a property <br /> of less than one-acre in size, it is permitted up to 2,000 square feet of accessory buildings. <br /> The existing garage is the only accessory building on the Property, and is 1,248 square feet <br /> in size with approval of the variance; and <br /> B7. The board or council may permit as a variance the temporary use of a one-family dwelling <br /> as a two-family dwelling; this condition is not applicable to the variance; and <br /> B8. The special conditions applying to the structure or land in question are peculiar to such <br /> property or immediately adjoining property; the existing garage consists of three levels built <br /> into a steep slope. This garage is located in an area where there is reasonable separation <br /> between it and the other buildings on the immediately adjacent properties; and <br /> B9. The conditions do not apply generally to other land or structures in the district in which the <br /> land is located; the conditions of the property do not apply generally to other land or <br /> 3 <br />
