10286.7 <br />TO: Mayor and City Council l( <br />FROM: Mark Bernhardson, City Administrate w� <br />DATE: October 2, 1986 <br />SUBJECT: Administrator's Information <br />HOWARD HULL REQUEST FOR SEWER SERVICE LIABILITY - The City is <br />currently studying the issue of liability and will probably be <br />discussing with Mr. Hull his submission of notice of claim so <br />that the insurance company can determine whether the City has any <br />liability in this matter. <br />COUNTY 19 SPEED REQUEST - ,,.e petition the City received for a <br />speed survey on County 19 has been submitted to Hennepin County <br />and it is our understanding they will be taking appropriate speed <br />studies of the area during the next month, the completion of the <br />study after Memorial Day 1987. <br />ULRICH PROPERTY/DNR PERMIT - The City of O ono received local <br />government notification of the water allocation permit for the <br />Ulrich property on September 29, 1986. The City through its <br />Attorney will be making a request for hearing and will be working <br />to develop appropriate expert testimony and rational fo denial <br />of the water allocation permit. The other permit required, that <br />of the discharge permit will not be acted upon by the DNR until <br />the hearing on water allocation permit. It is expected however, <br />that some of the City's argument related to the water allocation <br />will be where the water is discharged and the impacts that may <br />have. <br />CRYSTAL —BAY —SEWER —PROJECT - The City conducted its final <br />inspection of the project including Councilmember Tim Adams, <br />Public Works Coordinator John Gerhardson and City Engineers of <br />the final items related to the inspection. The City had notified <br />all the residents via letter of the upcoming inspection and <br />requested that they submit items either prior to that inspection <br />of September 17th or be present for the inspection. The items <br />from the inspection were noted and work is being done to correct <br />them with the contractor. Despite indications to the contrary <br />the contractor has not filed for bankruptcy and fully intends to <br />complete the project. It is anticipated that the project will <br />finish under amended budget. <br />COUNTY ROAD 15 STATUS - The City has received indication within <br />the last week that some of these monies will be allocated for <br />construction of the County 15 project in 1987 and that the <br />balance will be funded in 1988. It is anticipated that was done <br />for budgetary reasons and that the bulk of the construction will <br />not start until 1988. This is better news than had been <br />previously understood, as construction was slated for 1.989. It <br />
