Gaffron, <br />AEsistant Planning & Zoning Administrator <br />October 9, 1986 <br />#1073 JameE Deanovic, 2050 Shoreline Drive <br />Conditional Use Permit/Variance - Resolution <br />GGT i 1�2-u <br />original Application - Conditional use permit for grading in excess of <br />100 cubic yards and in excess of customary grading for new house. <br />This conditional use permit includes a variance because a small <br />portion of the grading is in the 0-75' lakeshore setback zone. <br />Additional Items: <br />1. Because the lakeshore parcel is a separate tax parcel, in order tc <br />legally allow a dock it must either have a house on it or be combined <br />with the residence (inland) parcel, hence a special lot combination <br />across County Road 15 is in order. <br />2. Because this property will then be considered as a lakeshore lot, <br />it has a lakshore yard and a rear yard, but no front yard by <br />definition, even though the house will face toward County Road 15. <br />The pool proposed to be constructed in the lakeshore yard does meet <br />the average lakeshore setback of houses on either side, and does meet <br />the 75' lakeshore setback; but, because this is a unique lakeshore Lot <br />with lakeshore yard bisected by a roadway, it is appropriate to grant <br />a variance to allow an accessory structure in what is functioning as <br />the front yard. <br />3. The roadway entering the property is a private easement, not an <br />outlot, hence the required setback from the priva'�-e roadway is <br />measured from the side lot line and is considered a si0e yard setback, <br />not a street setback.
