The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> � reports by City staff , comments by the owner and other interested <br /> persons , and the effect of the proposed variance on the health, , <br /> safety and welfare of the community. <br /> 6. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> . property in this zoning district: that granting the variance <br /> would not adversely effect traffic conditions , light , air nor <br /> pose a fire hazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the owner , but is necessary to • <br /> alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the owner ; and would be <br /> " in keeping with the spirit and intent of the zoning code and <br /> comprehensive plan of the City. <br /> • CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings , the Orono City Council hereby grants <br /> variances to Section 34 . 552 and 34 . S1g to allow construction of a 24 ' X <br /> 26. 1 ' addition to the rear of the existing house with a 4 feet setback at <br /> the east property line , a 5 feet setback from rear property line and an <br /> increase of 145 ' square feet of hardcover , subject to the following <br /> conditions: <br /> 1 . Applicant must direct all roof drainage away from the side <br /> . property lines . <br /> 2. Applicant is placed on notice that if additional <br /> improvements on the site involve hardcover , that existing <br /> hardcover must be removed to match the new hardcover proposed for <br /> the site . <br /> � <br /> 3 . No other variances are granted or permitted for this <br /> structure. . <br /> 4. . Authorities granted by this variance run with the property <br /> • not with the owner , but are permissive only and must be exercised <br /> by application for a building permit within one year of the date of <br /> Council approval , or this variance will expire on that date <br /> (April 11 , 1984) . <br /> • 5. Violation of or noncompliance with. any of the terms and <br /> conditions of this variance shall constitute a violation of the ' <br /> zoning code, shallautomatical.lyterminateanyauthority granted <br /> herein, and shall be punishable as a misdemeanor . <br />
