9. The property is surrounded by extensive wetland areas to the east <br />and south, the reviewing staff has determined that future access links <br />would not be appropriate or feasible through this property. <br />NOW, THEREFORE, BE IT RESOLVED that based upon either one or more <br />of the findings noted above, the City Council of the City of Orono hereby <br />approves the preliminary plat application of Dennis F. Kumlin involving the <br />property located at 2665 Fox Street per the preliminary plat drawings by <br />Coffin & Gronberg, Inc., dated August 22, 1984, revised July 18, 1986, and <br />further grants a street frontage variance for Lots 2 and 3 subject to the <br />following conditions: <br />1. Prior to final plat approval, applicant's surveyor must provide <br />septic design for mound system on Lot 2 and confirm 75 foot separation <br />between wetlands and proposed septic area. <br />2. Applicant to grant access and utility easements over private road <br />outlot (see form enclosed). <br />3. Applicant to submit proof that private covenants will assure <br />future upkeep and maintenance of private road (sample enclosed for <br />your consideration). <br />4. Access to Lots 1, 2 and 3 must be via private road. No direct <br />access onto Fox Street allowed. <br />5. Applicant must submit choices for name of private road prior to <br />final plat a-proval for Council's review and recommendation (see form <br />enclosed). <br />6. Private road to be constructed per standards set forth in Section <br />11,33, staff recommends the following based on limited to be served by <br />this road: <br />24' base <br />20' paved surface - curb required (20' finished width between <br />curbs) <br />40' paved cul-de-sac <br />7. Applicant must execute a Developer's Agreement and post <br />appropriate security for all road improvements not completed by final <br />plat approval (see sample enclosed). <br />8. City to ask a for a Flowage & Conservation Easement over wetlands <br />area. <br />Page 2 of 3 <br />
