Zoning File #1053 <br />Addition to Memo of 7/17/86 <br />August 7, 1986 <br />Page 1 of 2 <br />Additional Exhibits <br />Exhibit L - Plan Per Planning Commission Recommendation <br />Exhibit M - Applicant's Addendum Plan <br />Additional Comments, Planning Commission Recommendation and Staff <br />Alternative: <br />The applicant has once again asked staff to remind Council that <br />replacement or new structures within lakeshore yard consist of spaced <br />wooden decking (averaging 3/8 to 1/2 inch spacing) over natural ground <br />cover. Previous structure was impervious to runoff. Kosak advises that <br />the patio block under Decks G 6 H will be removed and replaced with <br />pervious ground cover and approximately 120 square feet of hardcover re- <br />moved (75 square feet in 75-250' zone; 45 square feet in 0-75'zone). <br />Staff would also like to take this opportunity to comment on a <br />specific criticism cited against the applicant questioning his statement <br />that he did not realize the need for a building permit. The majority of <br />our residents would not realize either the need for a building permit or <br />question the builder to assure that contractor had obtained a building <br />permit. Kosak's contractor has been issued all warning or citation tags - <br />not the owner. <br />Planning Commission recommends approval of the conditional use permit <br />and variances for the installation of a new retaining wall and replacement <br />of existing retaining wall based on the findings and conditions cited in <br />the staff recommendation on Page 4 of this memo. To approve the after -the - <br />fact hardcover and setback variances for structures within 75 feet of the <br />lakeshore amended as follows; (refer to additional Exhibit L) <br />a) To approve all upper story decks (G, H 6 4 feet wide walking deck <br />over Deck D) which would require a 10 foot setback variance for <br />portion of Deck G that encroaches 10 feet into protected lakeshore <br />area. No hardcover variance required because Decks G a H (10' above <br />grade) are located over natural groundcover. <br />b) Proposed grade level deck shown as Area F is not approved and must <br />be replaced with pervious groundcover. <br />c) All of Deck Area D within 75-250 setback area to remain. <br />d) Deck Area E must be altered by removing all portions of deck that <br />extend beyond 5 feet along pool side and then to jog back along <br />support beam as it extends northward (approximately 2 feet beyond <br />lakeside of pool) resulting in a total increase of 120 s.f of hard- <br />cover within the 0-75' setback area. <br />
