Zoning File 41052 <br />July 16, 1986 <br />Page 2 of 3 <br />The existing solid fence in its present location at the base of <br />the road bed is not visible from the elevation of the road but <br />obviously has served to protect his property from trespass and <br />provide privacy. <br />In the summer the shed is hidden by tree and shrub foliage. The <br />higher road elevations also tend to obscure the structure when <br />viewing lakeward. <br />Applicant want o rebuild the shed in the same location. <br />In a recent amendent approved by the Council, lockboxes on such <br />lots would be permitted if they did not exceed 20 s.f. in area <br />and 48 inches in height. The proposed shed is 48 s.f, in area <br />and 61+ in height. <br />The shed is currently loca��d 6 feet from the south property <br />line. The shed must be rebuilt 10 feet from the lot line or <br />another variance would have to be granted. If structure is moved <br />closer to base of road bed, this would provide less visual impact <br />from road and lake. Staff has been advised that applicant <br />requires the additional height because of the size of items <br />stored in structure. Planning Commission may consider an <br />expansion in size if applicant builds at the 48 inch approved <br />height - another step to reduce visual impact but will result in <br />more hardcover. <br />Staff Recommendation - <br />To approve the multiple variance application of John Spence to <br />allow the applicant to rebuild structures damaged in an auto <br />accident located within the lakeshore portion of his property and <br />located at 2040 North Shore Drive based on the following <br />findings: <br />1. An accident created need to make major structural repairs <br />to non -conforming structures. <br />2. The structures have existed on his lakeshore property for <br />several years. <br />3. There is no visual impact created from the lake or <br />roadway by the subject structures. <br />4. The proposed use of the structures are recognized as <br />conforming residential uses. <br />5. The City has always recognized the unique problems <br />associated with l-keshore lots divided by public roads and <br />has responded wit,.in reason. <br />
