Gaf.fron, ticUN� <br />ft <br />Assistant Planning & Zoning Administrator <br />Date: July 8, 1986 <br />Subject: #1035 Robert Koehnen, 537 Hanlon Avenue - <br />Code Interpretation <br />List of Exhibits <br />Exhibit A - Memo & Exhibits of 6/12/86 <br />Exhibit B - Planning Commission Minutes of 6/16/86 <br />The applicant originally applied for a variance for garage <br />street setback based on staff's early assumption that this is a <br />"through" lot. However, as the staff review progressed, the <br />status of the alley was qut stioned as to whether the lot line <br />adjacent to the alley is a "rear" lot line. <br />Please review the memo of 6/12/86. Both staff and Planning <br />Commission have concluded that the correct interpretation is that <br />the alley is not a street, that the lot line along the alley is a <br />rear lot line, and that a side -loading garage could be located <br />10' from this lot line. <br />Planning Commission recommended that the variance <br />application fee be refunded. If Council concurs with the staff <br />and Planning Commission interpretation, the application fee will <br />be refunded. <br />
