Zoning Amendment <br />April 23, 1986 <br />Page 4 of 7 <br />F. Amend Section 10.22 Subdivision 3 <br />Tree Removal Regulations - no trees within 75 feet of the shoreline <br />with the diameter of six (6) inches or more shall be removed without <br />first obtaining a permit from the City. Such nrmits shall be issued <br />by City staff provided that at least a like number of replacement <br />trees of a nature and placement acceptable to the staff are planted, <br />any question involving the number of trees to be replaced will require <br />Council approval. <br />The amendment will provide staff the necessary authority and <br />direction in issuing permits for tree removal - no longer <br />requiring Council approval. <br />G. Section 10.08 Subdivision 3(A) <br />Add the following performance standards: <br />(8) The special conditions applying to the structure or land in <br />question are peculiar to such property or immediately adjoining <br />property. <br />(9) The conditions do not apply generally to other land or structures <br />in the district in which said land is located. <br />(10) The granting of the application is necessary for the preservation <br />and enjoyment of a substantial property right of the applicant. <br />(11) The granting of the proposed variance will not in any way impair <br />health, safety, comfort, morals, or in any other respect be contrary <br />to the intent of the Zoning Code. <br />(12) That the granting of such variance will not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />demonstrable hardship or difficulty. <br />In the recodification of the code, these specific standards <br />applicable in all variance reviews were omitted. <br />B. Section 10.20 Subdivision 3 <br />Recreation Areas. Private gun clubs, archery ranges, ski slide, <br />provided the area is i:enced and no part of the principal use is less <br />than 150 feet from any lot line. <br />Note ridiny stables has been omitted from this section and <br />replaced with a separate section for riding academy. Planning <br />Commission has also asked that the requirea setback of 100 feet <br />be changed to 150 feet. <br />
