5. The City Counci 1 finds that the conditions existing on this
property are pE;:uliar to it and do not apply generally to other
property in this ning district; that granting the variance
would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would
not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the
applican; and would be in keeping with the spirit and intent of
the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby
grants a variance to the Municipal Zoning Code Section 10.22,
Subdivision 2 to perm t the construction of a detached garage which
will increase hardcover in the 75-250' lakeshore setback zone from the
existing 32.9% or 2,977 s.f. to 3,124 s.f. or 34.5%, subject to the
following conditions:
1. Adequate erosion protection shall be provided during the
grading and construction process.
2. The three existing sheds shall be removed.
3. The proposed 35'x25' garage shall be located as shown on the
proposed plan on file at the City office.
4. A grading permit and building permit must be obtained prior
to construction.
5. The maximum hardcover on the property shall be as follows:
0-75' setback zone - 196 s.f. or 5.8%
75-250' setback zone - 3,124 s.f. or. 34.5%
The applicant is advised that no additional hE mover above these
limits will be approved, and any future propo:. is for additional
hardcover might be approved only with concurrent removals of
existing hardcover.
6. Authorities granted by this variance run with the property
not with the applicant, but are permissive only and must be
exercised by application for a building permit within one year of
the date of Counci 1 approva 1, or this variance wi 1 1 expire on
that date (July 14, 1987).
