A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #1038 <br />WHEREAS, Gordon Nelson (hereinafter "the applicant") is the <br />owner of the property located at 1310 Elmwood Lane within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Lot 3, Block 6, Saga Hill Revised, and the adjacent h of vacated <br />Oak Place (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivision 2 to <br />permit the construction of a garage which will increase the hardcover <br />in the 75-250' lakeshore setback zone from 32.9V, to 34.5% where only <br />25% hardcover is normally allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1038. <br />2. The property is located in the LR-lB Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />June 16, 1986, and recommended approval of the proposed variance <br />based upon the following findings: <br />A) This year-round residence does not currently have a <br />garage. <br />B) Regrading of yard area may have some bent -icial effect <br />in reducing the rate of runoff from the property. <br />C) The garage will replace three small unsightly sheds <br />currently existing on the property. <br />D) The existing slopes on the property are a hardship in <br />that a suitable garage is not feasible unless the grades are <br />changed. <br />4. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />Page 1 of 4 <br />
